My understanding is that, at least in the US, it is completely legal
to record music you own for personal use (making copies for the car, the
office, whatever) and this falls under the fair use portions
of the copyright law. I discussed this with an attorney a few months
ago, who was the first attorney to prosecute a
case involving so-called "copy protection" scemes on CDs.
The attorney was Ira Rothken, who practices in Northern California and
specializes in high-tech law:
http://techfirm.com/
> outright theft.
But that's what I'm asking: when does it become 'theft?' The
moment you download something? What if you wind up buying it after hearing
and liking it? Is it theft then?
How can you make it possible for people to copy CDs they have purchased
-- which it is their legal right to do -- but not possible for people to
copy and distribute music? And would it be ethical to take away the rights
of consumers in order to punish those who won't put money out for the music
they're listening to?
> As for prices of CDs, I know they've blown out over the last couple of

I never would have bought CDs in Australia. They seemed astronomically
expensive, even after taking the exchange rate into account. I think the
only Australian CD I got when I was there was the "God" single.

Sure, but there's a counter-example. Let's say I read about an obscure
band in a magazine, and want to hear more from them. I go
to amazon, but the sound quality of the samples are disastrous. I don't
know anyone who listens to this band, so I can't borrow a copy
of the album to see if I like it. What then? If this is a
small, indie band, they would hope for me to buy their music
-- but I probably won't take the risk, as CDs are expensive.
While I agree that making mp3s is illegal, and it is within artists'
copyright to protect themselves from that kind
of duplication and distribution of their work, the amount of financial
damage a few teenagers with their computers (as you said yourself, the
number of people downloading these things is likely very small) can do
to a big-name artist is miniscule. But having the ability to trade music
by unknown or hard-to-find artists who don't get airplay is a real gift,
both to music buyers and to the artists themselves. In the long
run, I think that's worthwhile.
Beth

when the bullet hits the bone.... (couldn't resist ;) )
seriously though-
redstamen had a lot of cool insights about the whole shadow people thing I
had posted about and daniel elaborated on.
>in mixed company, i'd say "don't get me started" cuz really it's
>kind of embarassing how much i have to say about this topic.
I feel the same way about unexplained phenomenon- I've always been
fascinated by all thing paranormal, including aliens and UFOs, but at the
same time a little hesitant to talk openly about it around most people
because it seems like there's such a general disdain for such an interest
among the general public.
On the other hand, I wonder if some of that "disdain" is actually people
who have also had strange experiences but aren't coming forward about it.
> if the things i've
>seen should be explained as just hallucinations, well the men in white coats
>better come cart me off.
I think if everyone who's seen such things were "carted off" there would
only be a few "sane" people left ;) It's dissapointing that there's not
more mainstream acceptance of the unexplained- perhaps then people would
feel more free to be open about what they might have experienced.
>i think most people have a wall up subconsciously when it comes to
>perceiving "the other side" (i would even say there are other sideS, not
>just one). and some people for whatever reason (born-with-it, trauma,

>consistently that most other people don't.
I recall reading about how it's possible that everyone has some sort of
psychic ability, varying from person to person. Even people with no
obvious ability can still sometimes "tune in" on the "other side/s", like
getting the proverbial "bad feeling" about a situation before they get into
it, or getting a phone call from someone they were thinking about a short
while earlier.
Some people have precognitive dreams, and there are even people who have
reported having dreams about what can only be described as alternate
realities or timelines, sometimes going as far as to actually "percieve"
possible alternate versions of history- in effect, remembering an event,
and seeming to remember both possible outcomes. Knowing that one version
never actually happened but the memory of what never happened feels very
real.
I mentioned in an earlier posting the idea that perhaps some ghost or
shadow people sightings might actually be part of an alternate reality or
dimension briefly slipping into ours. It's also possible that shadow
people/ghost encounters might be sort of an "echo" of someone's past
actions in a particular location.
> but for a long time i met ghosts in several
>places i lived, and even in a place i worked. most of the times i would

Like what I had mentioned before- no one else around but you know someone
has been there. *Very* errie! A few times I've noticed what looks like
evidence on the carpet that someone or something had stood or walked in a
particular spot, when the only thing that should be on my carpet are the
"tracks" from my wheels and those funny tracks the vacuum cleaner makes.
>but the few times i've seen someone i don't know in my waking
>life appear or disappear like a ghost, it's been out of my peripheral vision
>and only for a few seconds.
Do they appear solid, like they're actually there or more transparent? And
do you see them long enough to be able to describe them?
I really like your take here on perception and the mind's filtering of input:
> when you see something out of your
>periphery though -- that's different -- it's NOT what you were focusing on,
>not what you thought you were seeing and it surprises you with an image
>before your mind has put it's filter of expectations in front of it. so i
>think if you were gonna "see" something like a ghost or shadow person, this
>is the likeliest way.
Reminds me a little of how people sometimes "saw" the alien in the
"Predator" films even when he had his "cloaking suit" turned on. If
someone just happened to be looking in the right direction, they'd spot the
minor distortion in the scenery the alien was standing next to.
The less you actually try to see a ghost or shadow person the more likely
it is you might see one!
night terrors:
>lots of people mix them up with nightmares...
>but you're not actually asleep when they happen, unlike nightmares where you
>are caught in the grips of REM.
I think I once read that this happens when your body has sort of fallen
asleep before your brain and the senses have gone into sleep mode. It can
also happen when you enter a partially awake state after a deep sleep-
brain and senses waking up ahead of your body waking up.
>this used to happen to me a lot as a kid, (which i hear is pretty common)
>but then they came back for a few years while i was in my early 20's,
>sometimes up to 8 or 9 episodes a night. i still have them every once in a
>great while, so i'm not totally rid of them, but something has changed, for
>the better i think, and i'm happy about that.
Now *that's* scary! It doesn't happen to me that often (thankfully!) and
it's only once on the nights that it does happen. Once in a while is scary
enough- I don't think I could handle it happening as frequently as it had
happened to you!
right on the mark with this description:
>-- physically i feel like i can't move, can't
>breathe, and i feel usually like something is sucking my soul out through my
>feet or my chest.
Sleep paralysis! Like suddenly it feels like a huge weight or pressure is
on you, and the "soul being sucked out" feeling is almost like the air in
the room is gone, and you can't make yourself wake back up. I've even
heard a loud static or buzzing sound when it's happened to me, like the
sound of machinery revving up.
> this is just a sensation though -- if that's not scary
>enough, sometimes they were accompanied by auditory and visual
>"hallucinations" -- as a kid i saw dark swirling masses come in through the
>door and spin around my feet,
Well I was feeling the little hairs on the back of my neck going up as I
read that! I've seen the same thing- along with a dark figure that I can
just barely make out to be a human shape, standing just outside of my field
of vision in the dark. The figure is visible in the dark because it's
*blacker* than the surrounding darkness in the room.

>my eyes and see little dark goblins sitting at the foot of my bed or on my
>desk or window sill. just sitting there like it was the most normal thing
>in the world.
do these "goblins" every do anything or try to interact with you? I've
always been way too scared to get a closer look at the dark figure I've seen.
>most often though i would hear things -- someone with a high
>pitched voice screeching or whispering my name right next to my ear, or
>sometimes just laughter or gibberish.
More hairs on the back of my neck stood up here! That's what I've heard as
well- the "voices breaking through static" sounds I mentioned earlier.
It's hard to tell if the unintelligible voices are speaking just low enough
that you can't understand them, or if they're speaking another language.
Your description of how it feels like it's much longer than it actually is
is also similar to what I've experienced, like time got stretched out, and
when one of those events ends for me I actually fall back asleep and then
wake up a little while later, and everything's fine, and I ultimately just
relax again listening to the radio and I'm asleep again.
You're right on the mark about how *lots* of people have had the same
experiences of "paralysis" or someone/something holding them down.
>it's cross cultural and old news too -- there are old drawings and paintings
>from europe, africa, south america of dark monster-like mythical creatures
>sitting on a sleeping person's chest.
All of that makes me wonder if there's more to it than just cross-cultural
mythology. I mean people in modern times seem less likely to readily
believe in such things but they report the same experiences. And more than
likely do believe in it after it's happened to them!
about the medical explantions and how they don't fit:
Years ago when it happened I had actually thought it was a prelude to
something neurological with me getting worse- beyond the relatively minor
problems I had always had when I was younger, but when I started running
across stories of people having similar experiences I too learned that it
wasn't related to other problems.
I hope the mainstream media covers things like this more in the future. In
a way it gives more credibility to what a lot of people know to be real
already, as well as letting other people who've experienced it not feel
weird or alone.
about a scientist initially dismissing it:
>and always suspected it was a weird physiological phenomenon, like having
>your REM sleep kick in while you're still conscious and your mind and body
>get surprised and you go into panic mode. that sounds reasonable.
Is that the same as when someone is sleepwalking? If REM sleep starts when
you're still partially awake, it's like having dream input superimposed
over your real sensory input.
> but then
>he actually had an episode of them for a while and it changed his entire
>approach -- even though he knew logically what was happening to his body
I don't think anyone could be rational at the moment it was actually
happening. It's just so intense that you can't stop and remember "oh yeah-
I know what this is...do x,y, and z things to deal with it" no matter how
much you've been told about it.
and again, your take on this is most interesting:
> when you are asleep, the other 90% of your brain that you
>don't use in waking life kicks into gear and perceives and thinks and feels
>things your body and your existence, your SOUL, can't handle in waking life,
>cuz we haven't evolved enough spiritually as a people.
Reminds me of what I've heard about astral projection and out-of-body
experiences. And it's believed by some people that your soul actually
travels about in a different dimension while you're asleep, which explains
the dreaming process.
But yes, I think you're on to something, that the brain opens up more while
we're asleep, way beyond what we experience while awake.
I like what you said here about dream visitors or halucinations during a
night terror:
>i think it's your mind perceiving something that maybe it's not
>supposed to yet -- and therefore it can be extremely frightening.
Now that would really explain things like the "dark figure" I've seen-
something's there but I'm never able to see more of it than that, nor can I
tell what it's intentions are.
> that
>transition you take every night as you go from a thinking rational waking
>person to a prone slumbering body with it's sole night guardman called the
>mind, i think it's where most people are bound to perceive things that make
>a lasting impression on their conscious mind (and therefore remember them
>the next day).
And in a similar vein, perhaps that's why sometimes we wake up feeling like
we're trying to remember something, and sometime later the recall of it
slowly comes into focus.
>
>rather than explain away ghosts and little demons and shadow people as
>mystical, or supernatural, or even spiritual messengers, i'm more
>comfortable with calling them natural parts of our world, that like those
>guys who insisted the world was flat, we as a people just don't "believe in"
>right now. later on, much later on, i bet people will look back at us and
>all our denial about this part of nature as backwards and blinded. that's
>my suspicion anyway.
I've thought the same thing :) Some people might call me weird, but
there's so much more beyond the so-called "rational" that I can't help but
think there's reality to it. I've never liked the usual "clinical" view of
the world some people try to push :)
Your ideas on this whole subject are pretty neat :)

I thought it weird on Monday when I guy got into the same elevator as me
with a guitar case strapped to his back. The first thing I thought was, "Is
there a gun in there?". It was weirder again that night when I got home and
saw on the news that a guy tried to assassinate the French president with a
rifle he'd concealed in a guitar case. Maybe I've just watched Desperado
too many times.
Before I get into the replies, I'd like to make it clear that I don't
really hold anything against anyone who downloads music off the net. I just
bore them to death with my views and that's the usually end of it. I know I

If you go to Hereinmyhead.com and go under diagnosed sounds, misc., you can
get a mp3 of the song that tori sang back-up for ferron. It's okay. If I
had heard the song before I knew that Tori was on it I don't think I would

I got A Sorta Fairytale yesterday and I have to say that I really like it.
It is definitely different than Tori's other songs but I still like it. I

okay, so I have a webcam right.. well I got an idea last night to

Simon said in my babble about my love of science and astronomy:
"....Still, I've always enjoyed reading and studying science is still a
hobby of mine- and me having cable is for the documentary channels rather
than the movie and sports channels most people get cable for ;)"
Sweeeeeet.. you're an intellectual! I don't dig sports unless
it's basketball in my cousins' driveway in Oklahoma. :D
Simon then said: "....even with that telescope, a 3 inch
reflector I could still get great views of Jupiter's largest moons,
Saturn's rings, and excellent close-in looks at the moon."
DUDE! that ROCKS! lol golly! what'd it all look like? are they
colored like they supposedly are in the professional pics taken by ppl
like NASA?
Simon then wondered: "I know my interest in space and astronomy
really was a sore spot with some people, like I was doing something
wrong, but I've never totally understood why one should be so angry at
someone for enjoying learning things on their own."
If you did it all the time (I did it a LOT when I was
younger--read I mean.) and hardly visited with the outer world, that's
probably all it was.. they probably just wanted you to visit THEM for a

Oh, and Simon.. I found the quote at that Fairy Tales website..
and saved it.. lemme c&p it.. okay, here it is:
Q: What music would you like to have played at your funeral?
Tori: Happy Phantom from Little Earthquakes. When I die, the only sad
thing is that I will really miss some of my friends. But I have a lot of
friends somewhere else, where I'm going, and that'll be groovy too. If I
cruise off, don't mourn, 'cause I'm gonna be somewhere bitchin'.
Simon to me on person-to-pet ESP: "Oh yes! Pets really do pick up when
someone isn't feeling well, or when they're excited. My sister's dog

My brother's dog picks up on them very well. When they were
fretting and worrying that the loan for their new house wouldn't go
through, she was laying around bummed too. And then they got the phone
call that the loan DID go through and they immediately were happy, and KC
(the dog) immediately started bouncing around the house and being happy..
crazy, isn't it? :)
Simon said of his experiences with writing: "I mean she was royally
pissed, like she had been personally hurt by what I had written and went
on and on about what a liar and manipulator I was, when all I had done
was write a very honest and emotional account of what I had been going

They use Real, and they use Windows Media.. I listen to it

sometimes they don't offer RA.. but they give you a CHOICE.
our wonderful Succubus Barbie said: "I'm so evil, my knee hurts. No, that

Subject: happy days
hi all! today i took my sis and neighbor to the pool. i spent 3 hours
today putting labels, stickers, and stamps on stuff for my dad. standing
up. the backs of my knees hurt for a while. oh well. you all read megan's
side of the feast story, here's mine (cyndi persuaded me to post it so i
did):
last night i went to a "feast" at laura's house. i drove my dad's car, which
i'm not very familiar with, but that's ok. i went to giant eagle first to
snag some pringles and ramen noodles, then i went to pick up megan. we
arrived at laura's at the same time as spam, and i put on the gray "lana"
(the one that makes me look like a bag of wet cement or a cloud). she gave
us these thingies that were basically yogurt and peaches in a cup. i'm not
fond of peaches, but i ate it anyway. it was OK. then we were playing around
with megan's beach ball, and we ate stuff. it was pretty good, too. then we
decided to play with the beach ball some more, only we coated it with water
from the froggy sprinkler thingy (i used the bird bath, and they accused me
of cheating!) which made it that much more interesting. i kept kicking the
ball because i was too lazy to hit it, and megan kept scolding me and
grabbing my wrists and telling me to HIT the ball and i couldn't stop
laughing. laura's 14-year-old, justin timberlake look-alike brother will
joined us, and spam kept attacking him. when it turned dark, laura brought
out candles and spam and will were being pyromaniacs and burning things. we
made "mudt" (coffee and hot chocolate - mmm!) and i got 2 rides in the
wheelbarrow - one from will and one from megan. i tried to give megan a ride
in the wheelbarrow, but it didn't work since i'm not strong enough to push
someone of her greatness. i was strong enough to tip the wheelbarrow over
(accidentally!), but the wheel just wouldn't move on the grass. oh well. i
let spam squirt a whipped cream smiley face on my belly (now THAT was
interesting!) and then i smeared it around and it felt funny. when i washed
it off with the hose, the front of my pants got soaked. laura gave us green
mint jello which was kind of gross, but i suppose it was better than the
mint pancakes she said she was going to make that we had to try. yuck. i
flung some at megan and she tipped my chair over backwards and i had trouble
getting up. heh heh heh... but anyway, when it was really late i changed and
we left. when i passed the school complex (around 11 pm), megan asked if i
wanted to go on the playground. i said sure, so we pulled in by the
kindergarten playground. spam was behind us driving home, so she pulled in
too. we hung around the playgrounds (we went to the other playground too)
for a while, and i started singing "the origin of love" (from "hedwig and
the angry inch") and megan got annoyed and started pushing me really high on
the swings (i get kinda scared when i go too high) and then when i got off
she started chasing me around (running while singing is interesting,
particularly when you're so out of shape you can't run fast - oh well, megan
and i run at the same speed despite our height differences). after i
finished singing, spam and i mooned the senior high, then i flashed it.
HAHAAAAAAAAAAA take that, franklin! wow. i feel so... rebellious? anyway,
after that it was pretty late so we decided to leave. so i took megan home,
then went home and went online for a while. then i went to bed. hooray. and
that's my story.
yes, i threw tennis balls at megan in 8th grade, 5 1/2 YEARS ago! i was
finally getting over my guilt when she BROUGHT IT UP AGAIN! jeez, way to
make me feel like an asshole! :) i know you're just teasing, and i'm STILL
sorry (that's the 8365789912nd time i've apologized...).
here cyndi, take these magic happy pills (midol): 00 now go take a nap and
you'll feel better!
well, off to neopets and then other stuff. bye bye!
